This Candidate Privacy Notice explains how Maysara Talent Partners (“Maysara”, “we”, “us” or “our”) collects, uses, shares and protects personal information about candidates and prospective candidates in connection with Talent Acquisition and recruitment activities.

It applies whether you apply directly, are referred to us, are introduced by a client or third party, or are identified by Maysara through professional networks, talent searches or other lawful sources.

1. Who we are

Maysara Talent Partners provides flexible Talent Acquisition services to organisations, including recruitment sourcing, screening, candidate management and related hiring support.

2. Who this notice applies to

This notice applies to candidates and prospective candidates whose personal information we process for recruitment-related purposes, including people who have not submitted an application but whom we identify as potentially relevant to an opportunity.

3. Information we may collect

Depending on the circumstances, we may collect and process information such as:

  • name and contact details;
  • location and work-authorisation information;
  • CV, employment history, qualifications, skills and professional experience;
  • professional profiles and publicly available career information;
  • role preferences, remuneration expectations, availability and mobility;
  • information provided during conversations, interviews or assessments;
  • communications with Maysara;
  • references and referee details;
  • background, qualification, identity or right-to-work verification information where relevant and lawful;
  • information recorded in recruitment or applicant tracking systems; and
  • other information you choose to provide that is relevant to a recruitment process.

4. Where we obtain information

We may obtain information directly from you or from sources including:

  • LinkedIn and other professional networking platforms;
  • LinkedIn Recruiter or similar talent-search tools;
  • job boards and recruitment platforms;
  • publicly available professional or business sources;
  • referrals and professional networks;
  • Maysara clients and their recruitment systems;
  • former employers, referees or verification providers where appropriate; and
  • other recruitment service or technology providers used in connection with an engagement.

If we identify you through a talent search or another indirect source, we aim to provide relevant privacy information at the appropriate point in our first communication or as soon as reasonably practicable, subject to applicable law.

5. Why we use candidate information

We use candidate information for legitimate recruitment and Talent Acquisition purposes, including to:

  • identify and contact potential candidates;
  • consider your suitability for current or potential opportunities;
  • understand your experience, preferences and availability;
  • communicate with you about recruitment processes;
  • present or discuss your candidacy with a client where appropriate;
  • coordinate interviews, assessments, offers and recruitment administration;
  • support client hiring processes;
  • maintain appropriate recruitment records;
  • comply with legal, regulatory and contractual obligations; and
  • protect our systems, candidates, clients and legitimate business interests.

6. Our legal basis for processing – United Kingdom

Where UK data protection law applies, we process personal information only where we have an appropriate lawful basis. Depending on the activity, this may include our legitimate interests or those of a client in carrying out recruitment and identifying suitable candidates, taking steps at your request before entering into an employment or other contract, compliance with legal obligations, or consent where consent is the appropriate basis.

Where we rely on legitimate interests, we consider whether those interests are overridden by your rights and interests. Where special category information or criminal-offence information is processed, we will identify an additional lawful condition where required.

7. Australian privacy requirements

Where the Australian Privacy Act 1988 and Australian Privacy Principles apply to Maysara’s handling of your personal information, we will handle that information in accordance with those requirements.

Where information is collected about you from another source, we will take reasonable steps to notify you of relevant collection matters, or ensure you are aware of them, where required.

8. Sensitive and special category information

We do not seek sensitive or special category information unless it is relevant and lawful to process it. This may include information about health or disability adjustments, diversity information, criminal history or other protected information in limited circumstances.

Where additional consent, authorisation or another legal condition is required, we will take appropriate steps before processing the information.

9. Sharing candidate information

Depending on the recruitment process, we may share relevant candidate information with:

  • clients or prospective employers for whom we are providing Talent Acquisition services;
  • authorised hiring managers, People/HR or Talent Acquisition personnel;
  • service providers supporting recruitment, communications, document storage, applicant tracking, verification or technology;
  • professional advisers where reasonably necessary; and
  • regulators, courts or authorities where disclosure is required or permitted by law.

We do not sell candidate personal information. We will not ordinarily send your CV or detailed candidacy information to a prospective employer outside the context of a relevant recruitment process without an appropriate basis for doing so.

10. Client recruitment systems

Maysara may work within a client’s applicant tracking system, email environment or other recruitment systems. In those circumstances, the client may separately determine how information held in its systems is used and retained. The client’s own privacy information may therefore also apply.

11. AI, automation and recruitment technology

Maysara may use recruitment technology, automation and artificial intelligence to assist with activities such as searching, sourcing, matching, organising, summarising, reviewing or analysing recruitment-related information.

Maysara uses human judgement as part of its recruitment activities. We do not intend to make decisions producing legal or similarly significant effects about candidates solely by automated means unless that processing is lawful and the required safeguards and information have been provided.

Where a technology materially changes how candidate information is processed, we will assess the privacy and data-protection implications and implement appropriate safeguards.

12. International handling and transfers

Maysara operates across international markets and may support clients in Australia, the United Kingdom and other locations. Candidate information may therefore be accessed, stored or processed outside the country in which you are located.

Where applicable law imposes requirements on overseas disclosure or international transfers, we will take appropriate steps to satisfy those requirements. This may include contractual protections or other recognised transfer safeguards.

As Maysara’s technology providers are finalised, we will identify additional countries of likely overseas disclosure where required and practicable.

13. How long we keep candidate information

We retain candidate information only for as long as reasonably necessary for the purposes for which it was collected, including recruitment, maintaining appropriate records, responding to potential future opportunities where lawful, resolving disputes, and meeting legal or contractual requirements.

Retention periods may vary depending on the recruitment process, the information involved and applicable law. When information is no longer required, we will take reasonable steps to delete, destroy or de-identify it as appropriate.

14. Security

We take reasonable technical and organisational measures to protect candidate information from misuse, interference, loss, unauthorised access, modification or disclosure. No method of storage or transmission is completely secure, but we seek to use safeguards appropriate to the nature of the information and our operations.

15. Your choices and rights

Depending on the law that applies to you, you may have rights to:

  • ask whether we hold personal information about you;
  • request access to information we hold about you;
  • ask us to correct inaccurate or incomplete information;
  • object to certain processing;
  • request deletion or restriction of information in circumstances provided by law;
  • withdraw consent where processing is based on consent, without affecting earlier lawful processing;
  • ask us not to contact you about future opportunities; and
  • raise a concern or complaint about our handling of your information.

Some rights are subject to legal exceptions and may differ between Australia and the United Kingdom. We may need to verify your identity before responding to a request.

16. If you do not want to be considered for opportunities

You can tell us at any time that you do not wish to be contacted about recruitment opportunities. We will take reasonable steps to stop recruitment contact and may retain limited information where necessary to record and respect that preference or meet legal obligations.

Where applicable, you may also have the right to complain to the relevant privacy or data protection regulator, including the Office of the Australian Information Commissioner in Australia or the Information Commissioner’s Office in the United Kingdom.

18. Changes to this notice

We may update this Candidate Privacy Notice to reflect changes in our services, technology, legal obligations or information-handling practices. The current version will show the date of the latest update.
